I have a client who is relatively young and receiving fairly large MCA payments from his Wife who is currently on Medicaid in Pennsylvania and in a SNF. He has asked me how to assist with protecting the payments he is receiving from Medicaid if he were to need to go into a facility. I have considered a Medicaid Asset Protection Trust for him as I don’t believe these distributions are considered “gift” that would impact his Wife’s eligibility. Anyone have any experience with this?
