ABOUT THIS WEBINAR:

There are many ethical challenges and legal responsibilities attorneys face when representing clients with cognitive impairments such as dementia. It’s important to know how to navigate the complexities of maintaining a normal client-lawyer relationship while addressing diminished capacity concerns.

Join Rebecca A. Hobbs, Certified Elder Law Attorney at O’Donnell, Weiss & Mattei, P.C., for a special CLE* session on this topic! She will cover strategies for assessing a client’s capacity, effective communication techniques, and implementing protective legal measures to prevent threats, fraud, undue influence, and manipulation.

Attorneys will also learn how to document concerns, involve trusted individuals appropriately, and employ legal mechanisms such as powers of attorney, guardianship, and fiduciary arrangements to safeguard vulnerable clients. Attendees will walk away understanding:

  • Ethical obligations under Rule 1.14 regarding clients with diminished capacity
  • Techniques for assessing and documenting client capacity
  • Legal safeguards to protect vulnerable clients from exploitation
  • How to balance client autonomy with protective actions

Plus, we will share insights on common ethical dilemmas in elder law and practical solutions to help attorneys mitigate the risk of client exploitation. Save your spot today!
