Elder law and estate planning attorneys know the realities of working with aging clients, but what happens if the individual you represent is no longer able to make clear decisions?
Rule 1.14 of the Model Rules of Professional Responsibility informs on the client-lawyer relationship where the client has diminished capacity. Normally, the lawyer is admonished to “maintain a normal client-lawyer relationship with the client.”
This presentation will cover:
- How to have a normal relationship with a client with diminished capacity
- When it is appropriate to take protective action against one’s client
- Whether to disclose the client’s condition
- Whether to offer emergency legal assistance in cases where the client is unable to establish a client-lawyer relationship or make judgments regarding the matter
- References to guidance from other organizations, such as ACTEC, that have promulgated comments or best practices

MEET THE PRESENTER
Chasity Sharp Grice
Trust and Estate Partner – The Estate and Family Law Group
Chasity is an attorney based in Memphis, TN. Admitted to the Bars of Tennessee and Texas, Chasity achieved her law degree from the University of Tennessee College of Law with a concentration in Transactional Tax Planning. She later received her LL.M. degree in elder law and estate planning from the Western New England School of Law.
Chasity has dedicated her career to serving families with disabled loved ones or seniors. She is a Commissioner with the ABA’s Commission on Law and Aging, a member of the Memphis Bar Association, and has been involved with several other organizations.
After working as an estate planning tax accountant for Certified Public Accounting firms, Chasity opened her own legal practice in 2010. In 2023, she and her partners founded The Estate and Family Law Group, PLLC, where they focus on estate planning, elder law, estate and trust administration, and domestic law.
