Child Caregiver Exception

    Hello,

    I am a New Jersey attorney and have never dealt with a case using the Child Caregiver Exemption. The client’s child has lived in the home and cared for the client for the past two years but has absolutely nothing to document what they did for the client.

    I have two questions:

    1. What type of supporting documentation is usually required in order to use this exemption to transfer the home; and

    2. Is there any way to request guidance on whether the transfer will result in a penalty period or is it just wait and see and request a fair hearing if needed?

    Any information that you can provide is greatly appreciated.
